TERMS OF SERVICE

Welcome to Monvielle.

These Terms of Service (“Terms”) govern your access to and use of monvielle.com, your purchase of products from Monvielle, and your use of the related website features, customer account functionality and services that we make available (collectively, the “Services”).

The terms “Monvielle,” “we,” “us,” and “our” refer to MONVIELLE, trading as Monvielle.

Please read these Terms carefully before using the Services or placing an order.

By accessing or using the Services or placing an order, you agree to these Terms together with our:

  • Privacy Policy;
  • Return & Refund Policy;
  • Shipping Policy; and
  • any additional terms or notices presented in connection with a particular product, promotion or service.

If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms excludes, restricts or limits any consumer right or remedy that cannot lawfully be excluded, restricted or limited.


1. Eligibility

You must have the legal capacity to enter into a binding contract under the laws applicable to you in order to make a purchase from Monvielle.

If you are under the age at which you may independently enter into a binding contract, you may use the Services or make a purchase only with the involvement and authorization of a parent or legal guardian where permitted by applicable law.

You agree to provide accurate, current and complete information when placing an order, creating or using an account, or otherwise interacting with Monvielle.


2. Customer Accounts

Certain features of the Services may allow you to access a customer account, view orders, manage profile information, or submit cancellation and return requests.

You are responsible for maintaining the security of any account access credentials, verification codes or devices used to access your account.

You must not:

  • provide another person with unauthorized access to your account;
  • impersonate another customer;
  • attempt to access another person's account; or
  • sell or commercially transfer your customer account.

Please contact us promptly if you reasonably believe that your account has been accessed without authorization.

Where reasonably necessary to protect customers or the Services, we may temporarily restrict access while investigating suspected fraud, unauthorized access or a security risk.


3. Products and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, materials, dimensions, prices and other information displayed through the Services are accurate.

However, product appearance may vary slightly because of:

  • screen and device settings;
  • photography and lighting;
  • reasonable manufacturing tolerances;
  • natural variations in materials; or
  • other characteristics inherent in the product.

Such reasonable variations do not affect your statutory rights where a product is defective, materially different from its description or otherwise non-conforming.

Product descriptions applicable when your order is placed form part of the information on which your purchase is based.

We may modify or discontinue products for future orders at any time.


4. Production After an Order Is Placed

Certain Monvielle products are produced or prepared after an order is placed and may not be held as finished inventory at the time of purchase.

Production or order-processing time is separate from carrier transit time.

Estimated processing and delivery periods are described in our Shipping Policy and, where applicable, during checkout.

A standard Monvielle product does not become personalized, custom-made or non-returnable merely because it is produced or prepared after your order is placed.

Different rules may apply where a product is genuinely:

  • engraved;
  • personalized;
  • made to individual specifications supplied by you; or
  • materially customized specifically at your request.

5. Product Sizing and Customer Selections

Where a product requires you to select a size, finish, color, configuration or other option, please review your selection carefully before completing your order.

Any size guides or conversion information provided by Monvielle are intended to help you choose an appropriate size. Sizing conventions may vary between regions and product types.

If you are unsure which size or option to select, please contact us before ordering.

Where Monvielle's voluntary return policy applies, an incorrectly selected standard size may be handled in accordance with our Return & Refund Policy.

Products altered or resized specifically at your request may be subject to different return rules where permitted by applicable law.


6. Product Care

Jewelry should be used, handled and stored in accordance with any product-care guidance provided by Monvielle.

To the extent permitted by applicable law, damage resulting solely from:

  • misuse;
  • accidents;
  • improper storage;
  • unauthorized repair or alteration;
  • handling inconsistent with clearly provided care instructions; or
  • normal wear and tear

is not treated as a manufacturing defect.

This does not affect statutory rights relating to products that were defective or non-conforming when supplied.

If you have a known sensitivity to particular metals or materials, please review the product information or contact us before purchasing.


7. Product Availability

All products are subject to availability and production capacity.

Adding a product to your:

  • cart;
  • wishlist;
  • favorites; or
  • customer account

does not reserve that product or guarantee its availability.

We may impose reasonable quantity limits where necessary to:

  • maintain availability;
  • prevent fraud;
  • prevent abuse of promotions;
  • prevent unauthorized commercial resale; or
  • comply with legal or operational restrictions.

If we cannot supply a product for an accepted order, we will contact you and provide the remedy required by applicable law, including an appropriate refund where applicable.


8. Placing an Order

When you submit an order, you are requesting to purchase the products and services identified during checkout.

Please review all information carefully before submitting your order, including:

  • products;
  • sizes and options;
  • quantity;
  • delivery address;
  • contact information;
  • shipping method;
  • price; and
  • applicable charges.

An automated acknowledgement confirming that we received your order does not necessarily constitute final acceptance of the order.

A binding sales contract is formed when Monvielle confirms acceptance of the order or at another point required by applicable law.


9. Order Acceptance and Cancellation by Monvielle

We may decline or cancel an order before fulfillment where reasonably necessary, including because of:

  • product unavailability;
  • inability to complete production;
  • an obvious pricing or listing error;
  • suspected fraud or unauthorized payment;
  • inability to verify information reasonably necessary to process the transaction;
  • shipping restrictions;
  • sanctions or other legal restrictions;
  • suspected unauthorized commercial resale;
  • technical malfunction; or
  • another circumstance that makes fulfillment unlawful or objectively impracticable.

If payment has already been collected for an order that Monvielle cancels, we will refund the amount due to you.

We will not cancel an accepted consumer order arbitrarily or in a manner prohibited by applicable consumer law.


10. Customer Order Cancellations

If you wish to cancel an order, submit your request as soon as possible using the Cancel / Return an Order function available through our website or contact:

Because some products enter production after an order is placed, we may not always be able to accommodate a voluntary cancellation after production or fulfillment has materially progressed.

However, this does not restrict any statutory cancellation or withdrawal right that applies regardless of production status.

Once an order has been dispatched, the applicable return procedure may need to be followed.

11. Prices

Product prices may change from time to time.

A price change will not affect an order after the applicable price has become contractually binding.

The amount payable for your order will be displayed during checkout as required by applicable law.

Depending on your destination and order, the checkout total may include:

  • product price;
  • applicable taxes;
  • shipping charges; and
  • other charges required to be collected by Monvielle.

International orders may also be subject to import duties, taxes or charges imposed independently by authorities or carriers where those amounts are not collected at checkout.

12. Pricing and Listing Errors

Despite reasonable efforts, occasional errors may occur in:

  • pricing;
  • promotions;
  • product descriptions;
  • availability;
  • shipping charges; or
  • other website information.

If we identify an obvious error before accepting an order, we may correct it and, where appropriate, ask whether you wish to proceed on the corrected terms.

If applicable law permits us not to honor an obviously erroneous price or listing, we may cancel the affected order and refund any amount already paid.

We will not rely on this provision simply because a different price later becomes more favorable to Monvielle.


13. Payments

Payments may be processed through authorized third-party payment service providers.

By submitting payment information, you represent that:

  • the information provided is accurate;
  • you are authorized to use the selected payment method; and
  • you authorize the applicable payment provider to process the amount displayed at checkout.

Payment providers may perform reasonable:

  • authorization;
  • identity-verification;
  • security; and
  • fraud-prevention checks.

A temporary payment authorization does not necessarily mean that an order has been finally accepted.

If payment cannot be authorized or completed, we may be unable to process the order.


14. Promotions and Discount Codes

From time to time, Monvielle may offer:

  • discount codes;
  • promotional pricing;
  • gifts;
  • special offers; or
  • other promotions.

Promotions may be subject to separate conditions concerning:

  • eligible products;
  • eligible customers;
  • geographical availability;
  • duration;
  • minimum purchase amount;
  • number of permitted uses; or
  • combination with other promotions.

Specific promotional conditions presented with an offer apply in addition to these Terms.

We may refuse use of a promotion where we reasonably determine that it has been obtained or used fraudulently, unlawfully or contrary to its clearly disclosed terms.

Promotional restrictions do not remove mandatory statutory consumer rights.


15. Shipping and Delivery

Orders may require a production or processing period before dispatch.

Current estimated processing times, carrier transit times, shipping destinations and shipping procedures are described in our Shipping Policy.

Shipping charges applicable to your order will be displayed during checkout before you complete your purchase.

Orders may be shipped using carriers such as:

  • DHL;
  • UPS; or
  • FedEx.

The carrier used may depend on the destination, postal code, service availability and other operational factors.

Unless a particular carrier is expressly guaranteed during checkout, Monvielle may select an appropriate available carrier.

Delivery estimates are not guaranteed delivery dates unless expressly stated otherwise.

Nothing in this section limits statutory rights concerning delayed or undelivered goods.


16. Production and Fulfillment Partners

Monvielle may use carefully selected third-party production, order-fulfillment and logistics partners to:

  • manufacture or prepare products;
  • package orders;
  • dispatch shipments; and
  • provide tracking or fulfillment services.

As a result, an order may be shipped directly from an international production or fulfillment location.

Your purchase remains a transaction between you and Monvielle.

The use of a production, fulfillment or logistics partner does not change Monvielle's obligations to you under applicable consumer law.

Personal information necessary for production, fulfillment and delivery is handled in accordance with our Privacy Policy.


17. Risk of Loss During Delivery

Where Monvielle selects or arranges the shipping carrier, risk of loss or damage remains with Monvielle until the products are delivered to you or to another person designated by you to receive them, except where applicable law provides otherwise.

If you independently commission a carrier that Monvielle did not offer or arrange, different rules may apply where permitted by law.

Please contact us if an order is lost or damaged during transportation.

18. Customs, Duties and International Orders

International orders may be subject to customs procedures and local import requirements.

Depending on the destination and checkout arrangement, customs duties, import taxes, brokerage fees or similar charges may:

  • be collected during checkout; or
  • be assessed independently after shipment.

Where such charges are legally the customer's responsibility and have not been collected by Monvielle, the recipient may be required to pay them to the relevant authority, carrier or service provider.

Customers are responsible for complying with applicable import restrictions in their destination country.

Nothing in these Terms permits Monvielle to impose undisclosed mandatory charges contrary to applicable law.


19. Returns, Refunds and Exchanges

Monvielle offers a voluntary 30-calendar-day return policy for eligible products in addition to applicable statutory rights.

Eligibility requirements, return shipping, refunds, damaged or defective products, personalized items, statutory withdrawal rights and cancellation procedures are described in our Return & Refund Policy.

We currently do not offer direct exchanges as a standard service.

Where an applicable law gives you a mandatory right to:

  • repair;
  • replacement;
  • cancellation;
  • refund;
  • price reduction; or
  • another remedy,

that right is not limited by our voluntary return policy.


20. Defective, Damaged or Incorrect Products

If a product is damaged, defective, materially non-conforming or incorrectly supplied, please contact us as soon as reasonably possible.

We may request reasonable evidence such as:

  • photographs;
  • video;
  • packaging photographs; or
  • a description of the issue

to help us evaluate the claim.

In appropriate cases, a confirmed claim may be resolved without requiring physical return of the affected product.

Depending on the circumstances and applicable law, the appropriate remedy may include:

  • repair;
  • replacement;
  • refund;
  • price reduction; or
  • another legally required remedy.

Please do not dispose of or alter an affected product until we provide further instructions.

21. Fraud Prevention and Transaction Security

We may conduct reasonable checks designed to prevent:

  • payment fraud;
  • account misuse;
  • unauthorized transactions;
  • identity misuse;
  • promotion abuse;
  • return fraud; and
  • other unlawful activity.

Where reasonably necessary, we may request additional information to verify an order.

We may delay, decline or cancel a transaction where we reasonably suspect fraud or unlawful activity, subject to applicable law.

We may cooperate with:

  • payment providers;
  • financial institutions;
  • carriers;
  • fulfillment providers; and
  • lawful governmental authorities

where reasonably necessary to investigate suspected fraud or comply with legal obligations.

Personal information used for these purposes is handled in accordance with our Privacy Policy.


22. Intellectual Property

Unless otherwise indicated, the Services and their contents, including:

  • the Monvielle name and branding;
  • logos;
  • product photographs;
  • graphics;
  • videos;
  • product descriptions;
  • written content;
  • designs;
  • layout; and
  • other original materials

are owned by or licensed to Monvielle and are protected by applicable intellectual property laws.

You may access and use the Services for your personal, lawful and non-commercial use.

Except where permitted by law or expressly authorized by Monvielle, you must not:

  • reproduce;
  • republish;
  • distribute;
  • commercially exploit;
  • modify;
  • sell;
  • publicly display; or
  • create derivative works from

our protected materials.

Nothing in these Terms transfers ownership of intellectual property to you.


23. Automated Access and Scraping

Except where expressly authorized by Monvielle or permitted by applicable law, you must not use:

  • bots;
  • crawlers;
  • scraping tools;
  • automated data-extraction systems; or
  • similar technologies

to systematically extract or commercially reproduce our product information, photographs, pricing, website content or other protected materials.

You must not use automated methods to:

  • interfere with the Services;
  • circumvent security measures;
  • gain unauthorized account access;
  • collect other users' personal information;
  • create an unreasonable technical burden; or
  • test system vulnerabilities without authorization.

This section does not prohibit normal indexing by legitimate search engines that comply with applicable technical directives.


24. Prohibited Uses

You must not use the Services:

  • for an unlawful or fraudulent purpose;
  • to infringe intellectual property, privacy or other legal rights;
  • to distribute malware or harmful code;
  • to interfere with website security;
  • to impersonate another person;
  • to submit materially false information;
  • to engage in harassment or unlawful threats;
  • to obtain unauthorized access to systems or accounts;
  • to circumvent access or security controls; or
  • to conduct unauthorized commercial exploitation of the Services.

Where reasonably necessary, we may restrict access to protect Monvielle, our customers or our systems from serious misuse.


25. Reviews, Feedback and User Content

If you voluntarily submit a:

  • product review;
  • photograph;
  • comment;
  • suggestion;
  • rating; or
  • other content

for publication through the Services (“User Content”), you represent that you have the right to provide it and that it does not unlawfully infringe another person's rights.

You retain ownership of your User Content.

By submitting User Content for publication through Monvielle, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format and display that content to the extent reasonably necessary to operate the relevant website or review feature.

Where applicable law requires separate permission for use of your content in advertising or other marketing materials, we will obtain such permission where required.

We may remove User Content where we reasonably believe that it:

  • is fraudulent;
  • is unlawful;
  • infringes another person's rights;
  • contains malicious content;
  • contains abusive or threatening material; or
  • materially violates these Terms.

26. Third-Party Services and Links

The Services may contain links to or integrations with third-party services.

Independent third-party services may be governed by their own terms and privacy policies.

We do not control independent third-party websites merely because they are linked from our Services.

Nothing in this section excludes any responsibility that applicable law places on Monvielle.


27. Shopify Platform and Data Processing

Our online store is hosted by Shopify, which provides the e-commerce infrastructure used to make the Services available to you.

When you visit, interact with or make a purchase through our store, Shopify collects and processes personal information relating to your interaction with the Services.

Because Monvielle currently uses Shopify features powered by Shopify Network Intelligence, Shopify may also process customer information to provide enhanced services that may include personalization, analytics, advertising, fraud prevention, product improvement and other platform functionality incorporating information from interactions with Monvielle, other merchants and Shopify.

Information submitted through the Services may be shared with Shopify and relevant third parties and may be processed in countries other than the country where you reside.

Purchases of Monvielle products are transactions between you and Monvielle. Shopify is not the seller of Monvielle products.

28. Website Availability

We make reasonable efforts to maintain the availability, security and proper operation of the Services.

However, we cannot guarantee uninterrupted or error-free website availability.

We may temporarily restrict or suspend website functionality where reasonably necessary for:

  • maintenance;
  • security;
  • technical upgrades;
  • emergency repairs;
  • legal compliance; or
  • circumstances outside our reasonable control.

We will make reasonable efforts to minimize unnecessary disruption.

A temporary website interruption does not affect rights arising from an order already accepted.


29. Website Information

General informational content on the Services is provided to assist customers and may occasionally contain errors or omissions.

Nothing in this section limits our responsibility for:

  • product descriptions forming part of your transaction;
  • information required by consumer law;
  • misleading representations prohibited by law; or
  • another matter for which liability cannot legally be excluded.

30. Statutory Warranties and Consumer Guarantees

Monvielle products remain subject to any mandatory:

  • statutory warranty;
  • legal guarantee;
  • conformity requirement; and
  • consumer remedy

applicable to the transaction.

Nothing in these Terms excludes or restricts an implied term, condition, warranty, guarantee or remedy where applicable law prohibits us from doing so.

Any voluntary warranty or commercial guarantee separately offered by Monvielle is additional to mandatory statutory rights unless lawfully stated otherwise.


31. Limitation of Liability

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

In particular, nothing is intended to exclude or limit liability for:

  • fraud or fraudulent misrepresentation;
  • death or personal injury where liability cannot lawfully be excluded;
  • mandatory product-safety liability;
  • mandatory consumer guarantees;
  • statutory remedies; or
  • another liability that applicable law prohibits us from excluding.

Subject to the above and to the fullest extent permitted by applicable law, Monvielle is not responsible for losses that:

  • were not reasonably foreseeable when the contract was formed;
  • result directly from your unlawful or material misuse of the Services or product;
  • result from an independent circumstance for which applicable law does not hold Monvielle responsible; or
  • constitute commercial or business loss arising from a purchase made exclusively for personal consumer purposes.

Nothing in this section reduces a remedy available under mandatory consumer law.


32. Responsibility for Unlawful Use

To the extent permitted by applicable law, you are responsible for losses directly and reasonably caused to Monvielle by your intentional:

  • fraudulent activity;
  • unlawful use of the Services;
  • unauthorized system access;
  • infringement of third-party intellectual property through content you submit; or
  • other serious violation of these Terms.

This section does not require a consumer to compensate Monvielle for Monvielle's own negligence, statutory responsibility, breach of contract or the consumer's lawful exercise of consumer rights.


33. Suspension or Termination of Access

We may suspend or terminate access to all or part of the Services where reasonably necessary because of:

  • material violation of these Terms;
  • fraud or suspected fraud;
  • unlawful conduct;
  • serious security threats;
  • material misuse of the Services; or
  • legal or regulatory requirements.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to address the issue.

Suspension of website or account access does not eliminate rights or obligations arising from an order already accepted unless applicable law permits otherwise.


34. Events Outside Our Reasonable Control

Monvielle will not be responsible for a delay or failure to perform an obligation to the extent that the delay or failure is caused by circumstances genuinely outside our reasonable control, which may include:

  • natural disasters;
  • war or civil unrest;
  • governmental restrictions;
  • widespread transportation disruption;
  • widespread telecommunications or infrastructure failure;
  • labor disruption;
  • major public-health emergencies;
  • serious international shipping interruption; or
  • similar extraordinary events.

We will make reasonable efforts to minimize the effect of such circumstances.

This section does not remove statutory rights concerning delayed, undelivered, defective or non-conforming goods.


35. Changes to the Services

We may update, modify or discontinue website features from time to time.

Changes to the Services will not retroactively alter the contractual terms applicable to an already accepted order unless:

  • you agree;
  • the change is required by law; or
  • applicable law otherwise permits the change.

36. Changes to These Terms

We may update these Terms to reflect changes in:

  • our Services;
  • business operations;
  • technology;
  • applicable law;
  • security requirements; or
  • other legitimate business needs.

The current version will be published on this page with an updated “Last updated” date.

Changes apply prospectively unless applicable law permits otherwise.

Where required by law, additional notice will be provided before a material change takes effect.

The terms applicable when an order was formed will continue to govern that order to the extent required by law.


37. Mandatory Consumer Rights

Consumer protection laws vary between jurisdictions.

Nothing in these Terms is intended to:

  • waive a statutory right that cannot legally be waived;
  • exclude liability that cannot legally be excluded;
  • shorten a mandatory legal guarantee;
  • prevent a lawful statutory cancellation or withdrawal;
  • restrict access to a legally protected remedy or court; or
  • otherwise reduce mandatory consumer protections.

Where a provision of these Terms conflicts with mandatory law applicable to your purchase, the mandatory law will prevail only to the extent of that conflict.

38. Governing Law and Jurisdiction

These Terms and contracts between you and Monvielle are governed by the laws of the State of Israel, without regard to conflict-of-law principles, subject to mandatory consumer protections applicable to you.

If you are acting as a consumer, this choice of law does not deprive you of mandatory protections available under the law of your country of habitual residence where those protections apply regardless of the chosen governing law.

Nothing in these Terms prevents a consumer from bringing proceedings before a court or authority available to them under mandatory applicable law.

For transactions that are not consumer transactions, and to the extent permitted by law, the competent courts of Israel will have jurisdiction over disputes relating to these Terms.


39. Severability

If a provision of these Terms is determined to be unlawful, invalid or unenforceable, it will apply to the maximum extent legally permitted or, where necessary, be treated as severed.

The remaining provisions will continue in effect unless applicable law requires otherwise.


40. No Waiver

If Monvielle does not immediately exercise or enforce a right under these Terms, this does not constitute a waiver of that right.

A waiver concerning one circumstance does not automatically constitute a waiver concerning another circumstance.


41. Assignment

You may not transfer your rights or obligations under an accepted order where doing so would materially affect our ability to fulfill the transaction, except with our consent or where applicable law gives you the right to do so.

Monvielle may transfer its rights or obligations as part of a legitimate:

  • business transfer;
  • corporate reorganization;
  • financing;
  • merger; or
  • sale of the business,

provided that doing so does not reduce mandatory consumer rights or materially disadvantage you contrary to applicable law.


42. Entire Agreement

These Terms, together with policies and additional terms expressly incorporated into them, constitute the agreement concerning your use of the Services and purchases from Monvielle.

This provision does not exclude:

  • representations that applicable law treats as binding;
  • legally required pre-contract information; or
  • rights that cannot legally be waived.
